TERMS AND CONDITIONS

These Terms and Conditions govern the use of the Slide Gaming website and the purchase of products from Slide Gaming.

By using this Website or placing an order through it, you agree to these Terms and Conditions. Nothing contained in these Terms and Conditions is intended to limit or exclude any rights that a consumer may have under applicable South African law.

Slide Gaming operates from South Africa and all transactions through the Website are governed by applicable South African law.

2. DEFINITIONS

For purposes of these Terms and Conditions:

“Company”, “Slide Gaming”, “We”, “Us” or “Our” means Slide Gaming (Pty) Ltd, trading as Slide Gaming.

“Customer”, “You” or “Your” means any person or legal entity accessing the Website or purchasing products from Slide Gaming.

“Website” means the Slide Gaming website available at https://www.slidegaming.co.za.

“Product” or “Goods” means any physical goods offered for sale by Slide Gaming, including but not limited to trading cards, trading card game products, collectibles, accessories and related merchandise.

“Pre-order” means a product ordered before its official release or before stock has been received by Slide Gaming.

3. USE OF THE WEBSITE

You may use the Website for lawful purposes only.

You may not use the Website in any manner that interferes with its operation, compromises its security, attempts to gain unauthorised access to systems or accounts, or infringes the rights of Slide Gaming or any third party.

We may temporarily restrict access to the Website where reasonably necessary for maintenance, security, fraud prevention or technical reasons.

4. PRODUCT INFORMATION

Slide Gaming takes reasonable steps to ensure that product names, descriptions, images, editions, languages, quantities and prices displayed on the Website are accurate.

Product images may occasionally be illustrative and packaging or minor presentation details may differ between manufacturing or distribution runs. Where a particular edition, language, set, configuration or product variation is material to the purchase, the applicable product listing will take precedence.

Customers should review the product description before placing an order, particularly for products that are available in different languages, editions or regional versions.

Nothing in this section limits a customer’s rights where goods supplied are materially different from the product ordered or materially different from their description.

5. ORDERS AND AGREEMENTS OF SALE

Placing a product in a shopping cart does not reserve that product and does not constitute an agreement of sale.

Products may become unavailable before checkout is completed.

Before completing an order, customers are given an opportunity to review their order, correct relevant information and decide whether to proceed with the transaction.

An order is submitted when the customer completes the checkout process and selects the applicable confirmation or payment option.

Payment must be successfully authorised or received before an order will ordinarily be processed.

Slide Gaming reserves the right, subject to applicable law, to decline or cancel an order where:

  • payment has not been successfully authorised or received;
  • stock is unavailable;
  • an obvious pricing or product-listing error has occurred;
  • the transaction is identified as potentially fraudulent or requires additional verification;
  • the delivery information provided is insufficient or invalid; or
  • Slide Gaming is otherwise unable lawfully or reasonably to fulfil the order.

Where Slide Gaming cancels a paid order, any amount due to the customer will be refunded in accordance with the Refund Policy below.

The minimum order value isR45, excluding delivery charges, unless otherwise indicated on the Website.

6. PRICES AND PRICING ERRORS

All prices displayed on the Website are stated inSouth African Rand (ZAR) unless expressly indicated otherwise.

Applicable delivery charges and other charges relating to the transaction will be displayed during checkout before the customer completes the order.

Slide Gaming takes reasonable steps to ensure that prices and delivery charges are correctly displayed.

If an obvious or genuine pricing error is discovered before an order is fulfilled, Slide Gaming may, subject to applicable law, contact the customer and offer the customer the option to:

  1. proceed with the order at the correct price; or
  2. cancel the affected product or order and receive a refund of the relevant amount paid.

Slide Gaming will not substitute a more expensive product or charge an increased amount without the customer’s agreement.

7. PAYMENT

Payment may be made using the payment methods displayed during checkout.

Payment providers may includePayfast,Yoco, or other approved third-party payment service providers made available from time to time.

Where payment is processed by a third-party payment provider, the transaction may also be subject to that provider’s applicable security procedures and terms.

An order will only be regarded as paid once payment has been successfully authorised or received by Slide Gaming.

Payment information is handled using the security mechanisms applicable to the selected payment provider and payment method. Customers should never send full payment card details to Slide Gaming by email, WhatsApp or other unsecured communication channels.

Slide Gaming takes reasonable measures to use payment systems appropriate for secure electronic transactions.

8. STOCK AVAILABILITY

All orders are subject to stock availability.

Although Slide Gaming takes reasonable steps to maintain accurate inventory information, discrepancies may occasionally occur due to simultaneous purchases, inventory errors, supplier issues, damaged stock or other circumstances.

If Slide Gaming is unable to supply a product after payment has been received, the customer will be notified.

Where appropriate, the customer may be offered an alternative product. No substitution will be made without the customer’s agreement.

If no acceptable alternative is agreed, the amount paid for the unavailable product will be refunded.

9. PRE-ORDERS

Pre-order products are products offered for purchase before their official release or before stock has been received by Slide Gaming.

Release dates and estimated arrival dates are based on information available from manufacturers, publishers, distributors and suppliers and are provided in good faith.

These dates are estimates and may change due to circumstances outside Slide Gaming’s reasonable control, including:

  • manufacturer or publisher delays;
  • distributor delays;
  • reduced supplier allocations;
  • international shipping delays;
  • customs delays;
  • release-date changes; or
  • other supply-chain disruptions.

Supplier Allocations

Trading card game and collectible products are sometimes subject to limited distributor allocations.

If Slide Gaming receives less stock than originally ordered and cannot fulfil all confirmed pre-orders, affected customer quantities may need to be reduced or cancelled.

Customers affected by an allocation reduction will be notified and will receive a refund for any quantity that Slide Gaming is unable to supply.

Supplier Price Changes

If a distributor or supplier materially changes the wholesale price of a pre-order product before release and Slide Gaming cannot reasonably fulfil the order at the originally advertised price, the customer will be informed.

The customer will then be given the option to:

  • proceed at the revised price; or
  • cancel the affected product and receive a refund of the amount paid for that product.

No additional amount will be charged without the customer’s agreement.

Pre-order Delays

A delay to a pre-order does not automatically mean that the product has been cancelled.

Where a material delay occurs, Slide Gaming will provide updated information where reasonably available.

Any right to cancel a delayed pre-order will be dealt with in accordance with these Terms and applicable South African consumer legislation.

10. ORDER CANCELLATION POLICY

Customers wishing to cancel an order should contact Slide Gaming as soon as possible atsales@slidegaming.co.za or via WhatsApp on072 453 1270.

Before Dispatch

Orders that have not yet been dispatched may generally be cancelled, subject to:

  • applicable South African consumer legislation;
  • any costs already reasonably incurred in connection with the order;
  • the nature of the goods ordered; and
  • any lawful conditions applicable to advance orders, pre-orders or special-order goods.

Where permitted by law, Slide Gaming may impose a reasonable cancellation charge in relation to an advance order or similar transaction.

Any cancellation charge will be determined reasonably in the circumstances and will not be imposed where prohibited by law.

After Dispatch

Once an order has been dispatched, cancellation may need to be handled as a return.

The customer may be responsible for applicable return delivery costs where permitted by law and depending on the reason for the return.

Nothing in this Cancellation Policy limits any statutory right a customer may have to cancel an electronic transaction.

11. STATUTORY COOLING-OFF RIGHTS

Nothing in these Terms and Conditions limits any cooling-off or cancellation rights available under theElectronic Communications and Transactions Act 25 of 2002, theConsumer Protection Act 68 of 2008, or other applicable South African legislation.

Where section 44 of the Electronic Communications and Transactions Act applies to an electronic transaction for goods, a consumer may cancel the transaction without reason and without penalty withinseven days after receiving the goods.

Where this statutory cooling-off right applies:

  • the customer may be responsible for the direct cost of returning the goods;
  • the goods must be returned to Slide Gaming as required by applicable law; and
  • any refund due will be processed within the period required by applicable law.

Certain transactions and categories of goods or services are excluded from the statutory cooling-off provisions by law.

This section does not restrict any separate right a customer may have in relation to defective, unsafe, incorrectly supplied or materially misdescribed goods.

12. DELIVERY AND SHIPPING POLICY

Slide Gaming currently delivers physical orderswithin South Africa using third-party courier service providers.

International delivery or export is not ordinarily offered unless expressly stated or separately agreed in writing.

Applicable delivery charges are displayed during checkout before an order is completed.

Dispatch

In-stock orders are ordinarily dispatched on Slide Gaming’s designated dispatch days as communicated on the Website.

Our standard dispatch day is Tuesday.

Orders received too late to be included in a particular dispatch may be dispatched on the following scheduled dispatch day.

Where Slide Gaming publishes a different dispatch arrangement on the Website, during holiday periods, special events or other temporary operational periods, the current information published on the Website will apply.

Pre-order products will only be dispatched after the relevant stock has been received and processed by Slide Gaming.

Delivery Times

Courier delivery times are estimates and may vary depending on:

  • the customer’s location;
  • courier service levels;
  • public holidays;
  • remote or outlying delivery areas;
  • severe weather;
  • road or transport disruptions; or
  • other circumstances outside Slide Gaming’s reasonable control.

Estimated delivery times are not guaranteed unless expressly agreed otherwise.

Where Slide Gaming becomes aware of a material delay or an inability to fulfil an order, we will contact the customer and provide the available options.

These may include continued fulfilment, an agreed alternative, or cancellation and refund where appropriate.

Tracking

Once an order has been dispatched, tracking information will be supplied where supported by the applicable courier and upon request.

13. DELIVERY ADDRESS

Customers are responsible for ensuring that the name, delivery address, telephone number and other delivery information supplied when placing an order are complete and accurate.

Slide Gaming and its courier partners will use the delivery information supplied by the customer when fulfilling the order.

If incorrect or incomplete information supplied by the customer results in a failed delivery, return-to-sender charge or redelivery cost, the customer may be responsible for reasonable additional delivery charges where permitted by law.

Customers should contact Slide Gaming as soon as possible if they notice an error in their delivery information.

Once an order has been dispatched, it may not be possible to change the delivery address.

14. GOODS DAMAGED IN TRANSIT

Slide Gaming takes reasonable measures to securely package goods for delivery.

Customers are encouraged to inspect the external condition of a parcel when it is delivered.

If obvious courier damage is visible, the customer should notify the courier and Slide Gaming as soon as reasonably possible.

If damage to the goods is discovered after opening the parcel, the customer should contact Slide Gaming as soon as reasonably possible and provide:

  • the order number;
  • a description of the damage;
  • photographs of the affected goods;
  • photographs of the internal and external packaging; and
  • any other information reasonably required to investigate the matter.

Providing photographs assists Slide Gaming with courier and distributor claims but does not remove any statutory consumer right merely because photographs are unavailable.

Slide Gaming will assess the matter and provide the appropriate remedy in accordance with applicable South African consumer legislation.

Where applicable, goods remain at Slide Gaming’s risk until delivery has been accepted in accordance with applicable law.

15. RETURN POLICY

Customers may return goods where they are entitled to do so under applicable South African consumer legislation.

This includes circumstances where goods are:

  • defective;
  • unsafe;
  • of unacceptable or poor quality;
  • incorrectly supplied;
  • materially different from their description; or
  • otherwise legally returnable.

Nothing in this Return Policy limits the statutory implied warranty of quality applicable to qualifying goods.

Where goods fail to meet the quality standards required by applicable law, Slide Gaming will provide the repair, replacement, refund or other remedy required by law and, where applicable, as directed by the consumer.

Change-of-Mind Returns

Except where a statutory cooling-off or return right applies, Slide Gaming does not ordinarily accept discretionary change-of-mind returns.

Customers may nevertheless contact Slide Gaming and we may consider a discretionary return on a case-by-case basis.

Any discretionary return accepted by Slide Gaming may be subject to reasonable conditions concerning the condition of the goods, packaging and return delivery costs.

A discretionary return does not create an ongoing obligation to accept similar returns in future.

16. TRADING CARD AND COLLECTIBLE PRODUCTS

Many products sold by Slide Gaming contain randomised contents, including booster packs, booster boxes and other sealed trading card or collectible products.

The contents of a randomised product are determined by the relevant manufacturer or publisher. Slide Gaming does not guarantee particular cards, rarities, pull rates, configurations or outcomes unless expressly stated in the product listing.

The failure to obtain a desired card or collectible from a randomised product does not by itself constitute a product defect.

Opened Products

Except where required by law, Slide Gaming does not ordinarily accept discretionary returns of:

  • opened booster packs;
  • opened booster boxes;
  • opened decks;
  • products with broken or removed factory seals;
  • products where protective wrapping has been materially removed or altered; or
  • other collectible products that are no longer in the condition in which they were sold.

This restriction doesnot limit a customer’s statutory rights where the product is defective, unsafe, incorrectly supplied, materially misdescribed or otherwise legally returnable.

17. TRADING CARD SINGLES

All trading card singles sold by Slide Gaming are expected to be inNear Mint (NM) condition, or as close to Near Mint as reasonably possible.

Due to the nature of trading cards, minor manufacturing imperfections may occur. These can include, for example, light print lines, minor edge or corner imperfections, slight centering issues, surface marks or other small factory-related variations.

Older release cards may also show minor signs consistent with their age and may not always meet the same condition standard reasonably expected of a newly manufactured card. Unless otherwise specifically stated on the product listing, Slide Gaming will nevertheless take reasonable care to ensure that singles offered for sale are as close to Near Mint condition as reasonably possible for the age of the card.

Slide Gaming doesnot individually grade or list the specific condition of every single card unless a particular condition issue is specifically disclosed in the product listing.

If a customer receives a card that they believe is materially below the condition reasonably expected under this policy, they should contact Slide Gaming as soon as reasonably possible and provide the order number together with photographs of the card where reasonably available.

Slide Gaming will assess the matter and, where appropriate, provide a reasonable remedy in accordance with these Terms and applicable South African consumer legislation.

Trading card singles are not ordinarily accepted for discretionary change-of-mind returns.

Nothing in this section limits a customer’s statutory rights where a card is incorrectly supplied, materially misdescribed, defective, or otherwise legally returnable.

18. DEFECTIVE OR POOR-QUALITY GOODS

South African consumer legislation provides consumers with statutory rights concerning safe and good-quality goods.

Where applicable, goods that fail to comply with the statutory standards of quality may be returned within the period prescribed by law.

Slide Gaming will not require a customer to deal directly with a manufacturer or distributor where applicable law places the responsibility for the remedy on Slide Gaming as the retailer.

Slide Gaming may communicate with a manufacturer, distributor or supplier when investigating or resolving a claim, but doing so does not remove any rights the customer has against Slide Gaming under applicable law.

Damage caused by misuse, abuse, unauthorised modification, improper storage or ordinary wear and tear is not necessarily a product defect and will be assessed according to the circumstances and applicable law.

19. REFUND POLICY

Refunds will be provided where required by applicable South African law or where Slide Gaming otherwise agrees to a refund under these Terms.

This may include circumstances where:

  • goods are defective or unsafe;
  • goods are incorrectly supplied;
  • goods are materially different from their description;
  • Slide Gaming cannot fulfil an order;
  • a pre-order allocation is reduced;
  • a qualifying order is lawfully cancelled; or
  • another statutory refund right applies.

Refund Method

Where reasonably possible and subject to the requirements of the applicable payment provider, refunds will be processed using the same payment method used for the original transaction.

Where a payment was made by card and the applicable payment processor requires the refund to be returned to the original card, the refund will be processed accordingly.

A refund will not exceed the amount originally paid for the affected transaction or goods.

Refund Processing Times

Once a refund has been approved, Slide Gaming will initiate the refund as soon as reasonably possible and within any period required by applicable law.

After a refund has been submitted by Slide Gaming or the payment provider, the time required for the funds to reflect in the customer’s account may depend on the customer’s bank, card issuer or payment provider.

Delivery Charges

Original delivery charges and return-delivery costs will be refunded or borne by Slide Gaming where required by law, including where applicable in relation to qualifying defective or incorrectly supplied goods.

Where a customer exercises a statutory cooling-off right for reasons unrelated to a defect or error by Slide Gaming, the customer may be responsible for the direct cost of returning the goods where permitted by law.

20. ORDER RECORDS

Customers will ordinarily receive an electronic order confirmation or other transaction record using the contact information supplied during checkout.

Customers with a registered account may also be able to access previous order information through their account on the Website.

Customers are encouraged to retain their order confirmation, invoice and payment confirmation for their records.

Slide Gaming retains transaction records in accordance with applicable legal, accounting, tax and operational record-retention requirements.

Customers may contact Slide Gaming if they require reasonable assistance obtaining information relating to a previous transaction.

21. PERSONAL INFORMATION AND PRIVACY

Slide Gaming processes personal information in accordance with its Privacy Policy and applicable South African privacy legislation.

Information supplied during checkout may be shared with payment processors, courier companies and other service providers to the extent reasonably necessary to process payment, fulfil the order, provide delivery, prevent fraud or comply with legal obligations.

Customers should review the Slide Gaming Privacy Policy for further information regarding the collection, use, storage and protection of personal information.

22. THIRD-PARTY SERVICES AND LINKS

The Website may contain links to websites or services operated by third parties.

Slide Gaming does not control third-party websites and is not responsible for their independent content, privacy practices or availability.

This does not affect Slide Gaming’s responsibilities for third-party service providers, such as payment processors or couriers, to the extent that applicable law places responsibility on Slide Gaming in relation to the customer’s transaction.

23. WEBSITE AVAILABILITY

Slide Gaming takes reasonable steps to maintain the Website and provide accurate information.

However, the Website may occasionally be temporarily unavailable because of maintenance, hosting issues, network interruptions, technical failures or circumstances outside Slide Gaming’s reasonable control.

Slide Gaming does not guarantee that the Website will operate continuously or without technical errors.

Nothing in this section excludes or limits any liability or consumer right that may not lawfully be excluded or limited.

24. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Website design, Slide Gaming branding, original text, graphics and other original content created by Slide Gaming are owned by or licensed to Slide Gaming.

Third-party trademarks, trading card game names, characters, artwork, logos and product images remain the property of their respective owners.

Nothing on the Website grants a customer ownership of any intellectual property belonging to Slide Gaming or a third party.

25. LIMITATION OF LIABILITY

To the maximum extent permitted by South African law, Slide Gaming will not be liable for indirect, incidental or consequential losses arising solely from the use or temporary inability to use the Website.

Slide Gaming will not be responsible for delays or failures caused by circumstances genuinely outside its reasonable control, provided that Slide Gaming continues to comply with any obligations imposed on it by applicable law.

Nothing in these Terms and Conditions:

  • excludes or limits liability that cannot lawfully be excluded;
  • excludes liability for gross negligence where such exclusion is prohibited;
  • removes a consumer’s statutory warranty or return rights;
  • restricts a remedy available to a consumer under applicable law; or
  • requires a consumer to waive any right that South African law does not permit a supplier to exclude.

26. FRAUD AND PAYMENT VERIFICATION

Slide Gaming may take reasonable steps to verify the legitimacy of an order or payment before dispatch.

Where an order is reasonably suspected to involve fraud, unauthorised payment activity or misuse of a payment method, Slide Gaming may delay fulfilment while the transaction is investigated.

Slide Gaming may request reasonable verification information where necessary.

If an order cannot reasonably be verified or a payment is reversed or declined, the order may be cancelled subject to applicable law.

27. GOVERNING LAW

These Terms and Conditions and transactions concluded through the Website are governed by the laws of theRepublic of South Africa.

Nothing in these Terms prevents a consumer from exercising any right to approach a consumer protection body, ombud, tribunal, court or other authority having jurisdiction under applicable law.

28. DISPUTE RESOLUTION

If a customer has a complaint concerning an order, product or these Terms and Conditions, the customer is encouraged to contact Slide Gaming first so that we have an opportunity to resolve the matter.

Slide Gaming will make reasonable efforts to investigate and resolve complaints fairly.

Nothing in this section prevents a customer from exercising any statutory dispute-resolution or enforcement right available under South African law.

29. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where possible.

The remaining provisions will continue to apply.

30. WAIVER

A failure by Slide Gaming to immediately enforce any provision of these Terms and Conditions does not constitute a permanent waiver of that provision or any other right.

31. CHANGES TO THESE TERMS AND CONDITIONS

Slide Gaming may update these Terms and Conditions from time to time to reflect changes in its business, Website, payment methods, delivery arrangements or applicable law.

The latest version will be published on the Website together with the date on which it was last updated.

Changes will apply prospectively.

Unless required by law, changes to these Terms and Conditions will not retrospectively remove rights or materially alter the terms applicable to an order that was already concluded before the updated Terms took effect.

32. CONSUMER RIGHTS

Nothing contained in these Terms and Conditions is intended to avoid, restrict or limit any right or remedy available to a consumer under:

  • theConsumer Protection Act 68 of 2008;
  • theElectronic Communications and Transactions Act 25 of 2002;
  • applicable regulations issued under those Acts; or
  • any other applicable South African legislation.

Where any provision of these Terms conflicts with a mandatory consumer protection provision, the applicable legislation will prevail.
